THIS PRIVACY POLICY SETS FORTH COMPANY’S PRIVACY POLICY FOR THE SITE, AND GOVERNS THE MANNER IN WHICH COMPANY COLLECTS, USES, MAINTAINS, AND DISCLOSES INFORMATION COLLECTED FROM USERS OF THE SITE.   1. OVERVIEW

Power Target recognizes and respects the privacy of users of the Site. This privacy policy, as modified from time to time by us as described below (the “Policy”), tells you about the information that Power Target collects through the Site and how we use the information we collect. If you access the Site, you are consenting to the information collection and use practices described in this Policy, as modified from time to time by us.

  1. UPDATES

Power Target reserves the right to make changes to this Policy at any time, and will post any revised Policy on this webpage. You will know we have changed the Policy when you see a new updated date at the top of this Policy. Power Target will not notify its Site users of any such changes by e-mail or other personal contact. We encourage you to check the date of this Policy whenever you visit this Site so that you will know when you need to review the Policy for modifications.

III. COLLECTION AND USE OF INFORMATION

Except as otherwise stated in this Policy, Power Target will not disclose the personal information that you provide except to Constellation, which will be considered the owner of that data.

Self-Reported Data. While using the Site, you may be asked to submit personal information in order to use the Site’s services and/or to enroll with Constellation as an electricity or gas supplier, or both. Such personal information may include, but is not limited to, your name, zip code, postal delivery address, e-mail address, phone number, and any other information necessary to enroll with Constellation through the Site.

Passively-Collected Data. Power Target may supplement the personal information you provide with publicly available information about you. Power Target may also track, collect, and report to Constellation aggregate, anonymous, statistical data, such as usage, traffic patterns, and user demographics based on your self-reported data.  This data this paragraph describes is not included in the term “personal information.”

Data Use and Disclosure. Power Target collects the above personal, public, and statistical information in order to allow or enhance Power Target’s or Constellation’s ability to provide you information about the available electricity and gas options in your area and to facilitate enrollment.   Power consumers who wish to enroll through the Site and submit information to Power Target for that purpose can reasonably expect Power Target to disclose that information to Constellation.  Either Power Target or Constellation may contact you to facilitate or correct an initiated enrollment.

Except as otherwise stated in this Policy, Power Target will use the personal information that you provide it only to do any of the following: (i) complete business transactions; (ii) contact you to keep you informed about Constellation products and services in which you may be interested; (iii) contact you as part of a Constellation promotion; (iv) meet legal requirements; or (v) provide customer support.

Power Target may use other companies, agents, or contractors to perform services on our behalf. For example, other companies may personalize our web pages, analyze and enhance data, including customers’ interaction with the Site, and process consumer surveys. In the course of providing such services, these other companies may have access to your personal information.  These companies are not permitted to use your personal information except for the purpose of providing the services Power Target obtains from them.

Power Target also reserves the right to disclose personal information when we reasonably believe disclosure is required by law or is necessary to establish or exercise legal rights. In the event that Power Target is acquired by or merged with a third party, we reserve the right as part of that transaction to sell or otherwise transfer the personal information we have collected provided that such third party promises to honor our privacy policy.

  1. VIEWING AND UPDATING YOUR INFORMATION

You are responsible for updating and maintaining the truth and accuracy of the personal information you provide to us.

  1. COOKIES AND OTHER TECHNOLOGY

Cookies. Power Target may use cookies and other tools to collect information about how you use the Site. A cookie is a small, unique text file that a website can send to your computer hard drive when you visit a site. Power Target uses both session cookies, which terminate when a user closes his or her browser, and persistent cookies, which remain on the user’s computer until manually deleted. Most web browsers can either alert you to the use of cookies or refuse to accept cookies entirely. If you do not want Power Target to deploy cookies in your browser, you can set your browser to reject cookies or to notify you when a website tries to put a cookie on your computer. Action Tags. Power Target may employ a software technology called action tags (also known as “web beacons,” “single pixel gifs,” “clear gifs,” or “web bugs”), which are similar to cookies, in order to gather information about the Site. Action tags help us identify and track the performance of web pages on the Site, therefore allowing us to measure the performance and quality of the Site and to manage Site content. In addition, Power Target, its advertisers, and/or vendors may use action tags in emails. This allows us to gauge the effectiveness of certain communications and the effectiveness of marketing campaigns by showing, for example, how many emails have been opened.

IP Addresses. An IP (Internet Protocol) address is a number that is assigned to your computer when you use the Internet. Power Target collects IP addresses and other technical information about your machine through your web browser such as your operating system, browser type, and referring URL for the purposes of, among other things, system administration, to report aggregate information to our advertisers and others, and to ensure the validity of user requests.

Log Files. Like most standard website servers, we gather certain information automatically and store it in log files, which contain information such as, among other things, IP addresses, browser type, operating system, ISP, date/time stamps, and referring pages. Among other things, this information allows us to track statistics and trends on an aggregate basis.

  1. SECURITY

You are responsible for maintaining the confidentiality of your account information and for restricting access to the computers and mobile devices through which you access the Site. Users of public or shared computers or unprotected mobile devices should log out at the completion of each visit to the Site.

Unfortunately, no security system can be guaranteed to be 100% secure.
